Terms of Use

These Terms of Use are entered into by and between the user (“you”, “your”) and 【ELANE GLOBAL PTE. LTD.】 and its affiliates (collectively “Shipfinder”, “we”, “us” or “our”). By using Shipfinder’s services (“Services”) or data (“Data”), you agree to these Terms. If your organization has a separate contract with us, those terms also apply.

We may update these Terms at any time. Changes are effective immediately upon posting or notification. Continued use constitutes acceptance. If you disagree, stop using the Services immediately.

1. User Obligations & Restrictions

You Must:

• • Use the Services/Data in compliance with all applicable laws.
• • Preserve all copyright and proprietary notices.
• • Delete all Data obtained via unauthorized means or upon termination of your agreement.

You Must NOT:

• • Illegal/Harmful Use: Use Data for illegal, deceptive, or unethical purposes, or anything damaging to Shipfinder’s reputation.
• • Financial Products: Use Data to create financial instruments, indices, or for trading/investment decisions.
• • Commercial Exploitation: Copy, resell, sublicense, publish, or use Data in advertising/marketing without prior written consent.
• • Technical Interference: Scrape, reverse engineer, modify, decompile, or interfere with our APIs or platforms.
• • Unauthorized Distribution: Share Data with unauthorized third parties or create “mirror” sites.
• • Upload Harmful Content: Submit inaccurate, defamatory, infringing, or virus-laden content.

2. Ownership & Nature of Data

• Exclusive Ownership:All rights, title, and interest in the Data and platform content belong exclusively to Shipfinder or its licensors. Data is confidential unless explicitly published publicly by us.

• “As Is” Basis: Data is provided for informational and internal business research purposes only. We do not guarantee accuracy, completeness, or timeliness.

• ￮ AIS Data Warning: Vessel positions come from public AIS signals and may contain errors due to technical limitations, weather, or human input. Positions may be delayed (up to 1 hour). Do not use for navigation safety.

• No Professional Advice: The Services do not constitute financial, legal, tax, or investment advice. Historical trends do not guarantee future results. You assume all risks associated with decisions made based on our Data.

3. Disclaimers & Limitation of Liability

• • Service Availability: We do not guarantee uninterrupted, error-free, or virus-free access.
• • Liability Cap: To the maximum extent permitted by law, Shipfinder is not liable for any direct, indirect, incidental, or consequential damages (including lost profits, business interruption, or data loss) arising from your use of the Services.
• • Exceptions: This limitation does not exclude liability for death/personal injury caused by our negligence, fraud, or other liabilities that cannot be excluded by law.
• • Third-Party Links: Links to external sites are for convenience only. We do not endorse them and accept no responsibility for their content or practices. Use them at your own risk.

4. Specific Service Terms

• • Insights & News: Provided for general background/promotional use. We are not obligated to update opinions or correct past statements.
• • Fleet Management & Tracking: By uploading data, you grant us a perpetual, royalty-free license to process and aggregate it (anonymized) to improve our Services.
• • Historical Data: We warrant we have the right to sell this data and will act if infringement claims arise. You may not reverse engineer or create derivative works from Historical Data without written permission.
